1. DEFINITIONS

To facilitate the reading of this document, the following terms are adopted:

  • Artistar or Platform: the web-based system available at www.artistar.com.br, including all of its features and functionalities;
  • User: any person who accesses, registers for, or uses the Platform;
  • Account: the profile created by the User after registration;
  • Content: any information submitted by the User to the Platform, including photos, product descriptions, prices, event information, and catalogs;
  • Catalog: the digital showcase created by the User to present their products, which may be public or private;
  • Legal Guardian: a parent or legal guardian responsible for a User under 18 years of age.

2. ACCEPTANCE OF THE TERMS

By accessing or using Artistar, you declare that you have read, understood, and fully agree to these Terms of Use.

If you do not agree with any provision of these Terms, you must not use the Platform.

If you are under 18 years of age, acceptance of these Terms must be made by your Legal Guardian, who shall also be responsible for the minor's use of the Platform.

These Terms constitute a binding agreement between you and Artistar, governed by Brazilian law, especially the Brazilian Civil Code, the Brazilian Internet Civil Rights Framework (Marco Civil da Internet), and the Consumer Protection Code.

3. THE PLATFORM

Artistar is a management tool for artists and creative sellers.

Through the Platform, Users may:

  • Register and organize product inventory;
  • Record and track sales in real time;
  • Plan and organize event schedules;
  • Create public or private digital product catalogs;
  • Monitor revenue and performance reports by event.

The Platform is available exclusively through a web browser and is offered free of charge as of the publication date of these Terms.

Artistar reserves the right to implement paid plans in the future, subject to prior notice to Users.

4. REGISTRATION AND ACCOUNT

4.1 Creating an Account

To use Artistar's features, it is necessary to create an account by providing:

  • Full name;
  • A valid email address;
  • An access password.

After registration, a confirmation email will be sent. The account will only be activated after validation of the provided email address.

4.2 Account Responsibility

You are solely responsible for:

  • Maintaining the confidentiality of your password;
  • All actions performed through your account;
  • Keeping your registration information accurate and up to date.

In the event of unauthorized access, you must immediately notify Artistar through the support channels.

4.3 Account Uniqueness

Each User may maintain only one active account. The creation of multiple accounts may result in the suspension or termination of the accounts involved.

4.4 Accuracy of Information

By registering, you represent that the information provided is true, complete, and current. False information may result in the immediate termination of the account.

5. MINORS

Artistar is accessible to Users of all ages.

  • Users under 13 years of age may only register with the express consent of a Legal Guardian;
  • Users between 13 and 17 years of age may use the Platform, although supervision by a Legal Guardian is recommended;
  • The Legal Guardian assumes full responsibility for the Platform's use by minors under their care.

6. USER CONTENT

6.1 Ownership

All Content submitted by the User remains the User's exclusive property. Artistar does not claim any intellectual property rights over such Content.

6.2 License to Use

By submitting Content to the Platform, the User grants Artistar a limited, non-exclusive, royalty-free license to store, display, and make such Content available solely for the purpose of enabling the Platform's operation.

Artistar will not use User Content in marketing campaigns, social media, or promotional materials without the User's prior express authorization.

6.3 User Responsibilities

By publishing Content, you represent that:

  • You possess the necessary rights to the published Content;
  • The Content does not infringe the rights of third parties;
  • The Content is not false, misleading, offensive, or unlawful.

Artistar may remove content that violates these Terms or applicable law.

7. PUBLIC CATALOG

The User may configure their catalog as:

  • Public: accessible to anyone who has the link;
  • Private: accessible only to the User or authorized persons.

The catalog visibility setting may be changed at any time through the account settings.

8. ARTISTAR'S RESPONSIBILITIES

Artistar acts exclusively as a management and organizational tool.

  • It does not participate in sales conducted by Users;
  • It is not a party to commercial transactions between Users and customers;
  • It does not validate products, prices, or registered events;
  • It assumes no responsibility for Users' commercial activities.

9. PROHIBITED CONDUCT

Users are expressly prohibited from:

  • Using the Platform for unlawful purposes;
  • Violating copyrights or intellectual property rights of third parties;
  • Submitting false or misleading information;
  • Accessing third-party accounts without authorization;
  • Attempting to obtain the Platform's source code;
  • Using bots, scripts, or automated systems without authorization;
  • Creating multiple accounts to circumvent restrictions;
  • Interfering with the operation of the Platform;
  • Publishing viruses, malware, or malicious code.

10. ARTISTAR INTELLECTUAL PROPERTY

The Artistar trademark, logos, interface, design, software, institutional texts, and all other Platform elements are the exclusive property of Artistar and are protected by applicable laws.

Reproduction, distribution, modification, or commercial use of such elements without express authorization is prohibited.

11. PLATFORM AVAILABILITY

Artistar strives to keep the Platform continuously available but does not guarantee uninterrupted availability.

The Platform may become temporarily unavailable due to maintenance, updates, technical failures, or events beyond Artistar's control.

12. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Artistar shall not be liable for:

  • Loss of data or lost profits;
  • Business decisions made by the User;
  • Acts or omissions of third parties;
  • Failures in devices, internet services, or external systems.

13. USER SUPPORT

Support is primarily provided in Portuguese, with English support available for international Users.

14. ACCOUNT TERMINATION

14.1 By the User

The User may request account termination at any time through the support channels.

14.2 By Artistar

Artistar may suspend or terminate accounts in cases of violation of these Terms, provision of false information, misuse of the Platform, or legal requirements.

15. COMMUNICATIONS

By creating an account, the User agrees to receive communications related to the operation of the Platform.

  • Transactional emails essential to the operation of the account;
  • Marketing emails, which may be unsubscribed from at any time.

16. CHANGES TO THE TERMS

Artistar may update these Terms to reflect changes to the Platform, legislation, or service practices.

Changes may be communicated via email, notices on the Platform, or through the official Discord server.

17. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Federative Republic of Brazil.

Any disputes shall be submitted to the courts of the Judicial District of Santos, State of São Paulo.

18. GENERAL PROVISIONS

  • If any provision is deemed invalid, the remaining provisions shall remain valid and enforceable;
  • Artistar's failure to enforce any provision shall not constitute a waiver of rights;
  • These Terms, together with the Privacy Policy, constitute the entire agreement between the User and Artistar.
